Who Qualifies for Spousal Support in California?

Does your spouse earn a significant percentage of your household income? Divorce laws in California offer protection to the spouse who earns less money. Equally, the laws place limits on the collection of spousal support by a spouse who does not meaningfully contribute to the marriage. Alimony or spousal support can be awarded by a judge to either the wife or husband, depending on the circumstances that exist.

Calculating Spousal Support in California

Generally, the duration of a spousal support order in California is half the length of the parties’ marriage. Under the California Family Code, a marriage that lasts for ten years or longer is a “long-term marriage,” allowing courts to exercise continuing jurisdiction to determine matters of spousal support. Importantly, a court may craft a spousal support obligation that lasts indefinitely.

Unlike child support, spousal support awards depend on the marital status of the parties. A spousal support obligation ends upon the death or remarriage of the parties. Some courts have also held that romantic cohabitation between the spouse receiving support and a subsequent romantic partner may be grounds for terminating a spousal support obligation.

Under California Family Code § 4320, California courts are required to consider several factors when determining issues of spousal support. Generally, spousal support aims to ensure that a person has enough financial resources to cover the cost of living at the marital standard of living they enjoyed at the time they separated from their spouse.

Several factors courts must consider when crafting a spousal support award include, among others:

  • The length of the parties’ marriage
  • The station in life the parties attained when they separated
  • A party’s capacity to become financially self-supporting within a reasonable time after divorce
  • The health of the parties
  • Each party’s financial resources
  • The financial needs of the parties
  • The financial obligations of the parties
  • The party’s childcare responsibilities
  • The earning capacity of the parties
  • The education, background, training, and work experience of the parties
