Grandparents' Rights in California

In California, grandparents may seek reasonable visitation rights with their grandchild if there is a pre-existing relationship between the grandparent and grandchild that has been endangered, and that the relationship is in the child’s best interests. Grandparents usually cannot request visitation rights if the child’s parents are married, except under the following circumstances:

  • The child does not live with either parent
  • The grandchild has been adopted by a stepparent
